By accessing or using Mtaani ("the Platform", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Platform. These Terms apply to all visitors, users, and others who access or use the Platform.

Mtaani is a local business, events, and services directory platform that connects communities in Kenya. The Platform allows:

Business owners to list and promote their businesses.
Event organizers to create and advertise local events.
Service providers to offer their professional services.
Users to discover, review, and engage with local listings.

3. User Accounts

To access certain features of the Platform, you must register for an account. You agree to:

Provide accurate, current, and complete information during registration.
Maintain and promptly update your account information.
Keep your password confidential and not share it with third parties.

Accept responsibility for all activities that occur under your account.

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive, or harmful behavior.

4. User-Generated Content

Users may submit content including business listings, event details, service descriptions, reviews, images, and other materials ("User Content"). By submitting User Content, you:

Grant Mtaani a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute your User Content on the Platform.
Represent that you own or have the necessary rights to submit the content and that it does not infringe any third-party rights.
Agree that your content is accurate, not misleading, and complies with all applicable laws.

We reserve the right to remove any User Content that violates these Terms.

5. Prohibited Conduct

You agree not to:

Post false, misleading, or fraudulent listings or reviews.
Harass, threaten, or harm other users.
Use the Platform for any unlawful purpose.
Attempt to gain unauthorized access to any part of the Platform or its systems.
Scrape, crawl, or use automated means to access the Platform without permission.
Impersonate any person or entity or falsely represent your affiliation with any person or entity.
Post spam, unsolicited advertisements, or promotional material.
Upload malicious code, viruses, or any software that could harm the Platform.

6. Business Listings & Accuracy

Business owners and service providers are solely responsible for the accuracy of their listings. Mtaani does not verify, endorse, or guarantee the quality, safety, or legality of any business, event, or service listed on the Platform. We encourage users to exercise due diligence before engaging with any listing.

7. Reviews & Ratings

Reviews and ratings submitted by users reflect their personal opinions and experiences. Mtaani does not endorse or verify reviews. We reserve the right to remove reviews that are abusive, fraudulent, irrelevant, or violate these Terms. Attempting to manipulate ratings through fake reviews is strictly prohibited and may result in account termination.

8. Intellectual Property

The Platform and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Mtaani and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without prior written consent. You may not copy, modify, distribute, or create derivative works from our Platform without explicit permission.

9. Privacy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to our collection and use of your data as described in the Privacy Policy.

10. Third-Party Services

The Platform may contain links to third-party websites, services, or integrations (including mapping services, payment processors, and social media platforms). We are not responsible for the content, privacy practices, or terms of any third-party services. Your use of third-party services is at your own risk and subject to their respective terms.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Mtaani and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Platform or any content thereon. Our total liability for any claim arising from your use of the Platform shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

12. Disclaimers

The Platform is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya, including the Kenya Information and Communications Act, the Computer Misuse and Cybercrimes Act, 2018, and any other applicable Kenyan legislation, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Kenya.

We reserve the right to modify these Terms at any time. We will notify registered users of material changes by email or through a prominent notice on the Platform. Your continued use of the Platform after the effective date of the revised Terms constitutes your acceptance of the changes.
